Kernan said that under California law, any  actor has the right to protect their name and likeness.  RapidShare,  Kernan said, is illegally using Vette's likeness and content to sell  memberships to its sites.&lt;br /&gt;&lt;br /&gt;"RapidShare is trying to redefine itself as a Google, when in fact it is  more like Napster and making a profit out of selling pirated content.  It's downloading copyright protected material," Kernan said.&lt;br /&gt;&lt;br /&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;br /&gt;"The adult industry has complained bitterly about torrent sites and file  sharing sites like RapidShare destroying the business, but for some  reason no one has stepped up to the plate and done anything about it.  Instead of whining, I decided to put my money where my mouth is, and  retained an attorney to sue them. I have lots of popular exclusive  content like my 'Lavatory Occupied' series that is repeatedly available  on RapidShare for download without my permission."&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Vette said she decided to sue after repeatedly sending cease and desist  letters that were ignored by RapidShare.&lt;br /&gt;&lt;br /&gt;"RapidShare promised me they would "filter" their content, but I just  found 'Lavatory Occupied'... once again... sitting on their servers and  free to the world. I think it must be deliberate, or they just don't  care.They seem to feel they are immune to action," Vette said.&lt;br /&gt;&lt;br /&gt;"Anytime I mention this to other people in the business I am shocked  that they shrug their shoulders and seem resigned to the stealing that  is going on. Napster was forced to comply with the law after being sued.  I am hoping to set an example. Just because my content is adult does  not mean that it is not worthy of protection. It costs me money to make  it, and it is valuable to me. Just a couple of months ago a comic book  publishing consortium got an injunction for similar infringing behavior  against RapidShare. I figured that it was a great time to strike," Vette  said. &lt;br /&gt;&lt;br /&gt;RapidShare's U.S. attorneys were not available for comment at press  time. &lt;br /&gt;In a related story, XBIZ reported today that Perfect 10, which also  filed a suit against RapidShare won a motion to deny RapidShare from  postponing a preliminary injunction hearing set for May 12 and moving  the venue to Germany. The hearing will be heard in San Diego District  Court as originally scheduled. &lt;br /&gt;“RapidShare didn’t want a U.S. court to have the opportunity to hear the  case," Perfect 10 owner Norm Zeda told XBIZ. "They wanted the case  tried under German law." &lt;br /&gt;&lt;br /&gt;Zada filed a preliminary injunction April 12 against RapidShare, saying  the company is stealing, copying and selling his copyrighted material. &lt;br /&gt;RapidShare's response in a memorandum stated that Perfect 10 has  declined to provide RapidShare with the links to files it asserts are  among hundreds of millions of user files on RapidShare’s site, which  RapidShare would gladly remove if Perfect 10 shared this information. &lt;br /&gt;&lt;br /&gt;According to Zada, RapidShare admits to selling the content, but not to  copying it, saying the material ended up on its servers, which are  located in Germany, through anonymous third parties. &lt;br /&gt;&lt;br /&gt;RapidShare claimed it's a storage site where users can store and share  files and view licensed content, including video games and movie  trailers from Warner Brothers in Germany. &lt;br /&gt;&lt;br /&gt;But Zeda argued, "They’re not a storage locker. RapidShare is the  greatest infringing paysite of all time. If the ISPs choose not to do so, they could  face legal liability.&lt;br /&gt;&lt;br /&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;div class="cnet-image-div image-REGULAR float-right" style="width: 184px;"&gt;  &lt;/div&gt;Both the &lt;a href="http://news.cnet.com/8301-13578_3-10195547-38.html"&gt;Obama  administration&lt;/a&gt; and the &lt;a href="http://news.cnet.com/8301-13578_3-10047945-38.html"&gt;Bush  administration&lt;/a&gt; had rejected requests from civil libertarians and  technologists for copies of the Anti-Counterfeiting Trade Agreement, or  ACTA. Last year, the White House went so far as to invoke an executive  order saying disclosure would do "damage to the national security." &lt;br /&gt;But after the European Parliament &lt;a href="http://news.cnet.com/8301-13578_3-10467337-38.html"&gt;voted&lt;/a&gt; last  month by a 633-to-13 margin to demand the release of ACTA's text,  keeping it secret became too politically problematic for the countries  represented in the closed-door negotiations. Besides the United States,  the European Commission, Australia, Canada, Japan, and New Zealand are  among the nations participating. They've been egged on &lt;a href="http://www.iipa.com/aboutiipa.html"&gt;by copyright lobby groups&lt;/a&gt;. &lt;br /&gt;Much of the language in ACTA has been anonymously proposed by one nation  or another but is not final, and it's not clear whether the "disabling  access" section will remain. Another nearby paragraph does say, in a nod  to privacy concerns, that governments should not "impose a general  monitoring requirement" on broadband providers. The language does appear  to go further than U.S. laws governing broadband providers and  copyright. &lt;br /&gt;The wording is slightly different from &lt;a href="http://www.laquadrature.net/en/0118-version-of-acta-consolidated-text-leaks"&gt;an  earlier draft&lt;/a&gt;, which talked about yanking the accounts of "repeat  infringers" and was leaked last month by a French digital rights group. &lt;br /&gt;The European Union published the draft text of ACTA on its Web site on  Wednesday, along with a &lt;a href="http://trade.ec.europa.eu/doclib/press/index.cfm?id=552"&gt;statement&lt;/a&gt;  from EU Trade Commissioner Karel de Gucht saying concerns about the  document's sweep were "unfounded." &lt;br /&gt;De Gucht noted, for instance, that suspected language such as a "three  strikes" rule for broadband customers and a "gradual response" for  suspected infringement was not in the ACTA draft. &lt;br /&gt;In general, ACTA's proposals seek to export controversial chunks of U.S.  copyright law to the rest of the world. The Digital Millennium  Copyright Act's "&lt;a href="http://news.cnet.com/2010-1071-825335.html"&gt;anti-circumvention&lt;/a&gt;"  section, which makes it illegal to bypass copy protection even to back  up a Blu-Ray disc, is in there. So is the &lt;a href="http://news.cnet.com/2010-1071-982121.html"&gt;No Electronic Theft  Act's&lt;/a&gt; concept of making it a crime to copy a sufficient quantity of  software, music, or videos -- even if no money changes hands. &lt;br /&gt;While the public draft version of ACTA wouldn't prohibit border guards  from searching travelers' gadgetry for infringing files, nor would it  appear to require that action. That has been one of the concerns of  groups like the Electronic Frontier Foundation and Public Knowledge,  which have &lt;a href="http://www.eff.org/issues/acta"&gt;criticized&lt;/a&gt; the  draft treaty. &lt;br /&gt;The U.S. Trade Representative said in a &lt;a href="http://www.ustr.gov/about-us/press-office/press-releases/2010/april/office-us-trade-representative-releases-statement-ac"&gt;statement&lt;/a&gt;  last week that recent ACTA negotiations in New Zealand were  "constructive." The next meeting is in Switzerland in June. &lt;br /&gt;&lt;b&gt;Update late Wednesday:&lt;/b&gt; By now, there has been a flurry of  responses to the release of the ACTA draft, including the Motion Picture  Association of America &lt;a href="http://www.mpaa.org/press_releases/mpaa%20statement%20on%20draft%20anti%20counterfeiting%20agreement.pdf"&gt;saying&lt;/a&gt;  it is an "important step forward" and deserves to be adopted. The &lt;a href="http://www.copyrightalliance.org/"&gt;Copyright Alliance&lt;/a&gt; likes &lt;a href="http://blog.copyrightalliance.org/2010/04/ustr-continues-transparency-on-acta/"&gt;it  too&lt;/a&gt;. Public Knowledge, on the other hand, remains concerned that  ACTA attempts "to export a regulatory regime that favors big media  companies at the expense of consumers and innovators." The information is used to pursue legal action against the Rapidshare users and at least one alleged uploader saw his house raided.&lt;/p&gt;  &lt;p&gt;Like many new releases, Metallica’s latest album “Death Magnetic” was uploaded to the popular file hosting service Rapidshare one day prior to its official release date last year. Since users don’t broadcast their IP-address or distribute files to the public directly though Rapidshare, it came as a surprise when the police raided the house of an uploader a few weeks ago.&lt;/p&gt;  &lt;p&gt;At first it was unclear how the identity of the uploader was revealed, but today German news outlet Gulli said it had &lt;a href="http://www.gulli.com/news/rapidshare-abmahnung-f-r-2009-04-25/"&gt;found out&lt;/a&gt; that this was likely to be accomplished by creative use of &lt;a href="http://bundesrecht.juris.de/urhg/__101.html"&gt;paragraph 101&lt;/a&gt; of German copyright law. It turns out that several record labels are using this to take legal action against those who share music on Rapidshare.&lt;/p&gt;  &lt;p&gt;Previously the paragraph was only used by rights holders to get the personal details of those who share copyrighted works on file-sharing networks. It basically enables the copyright holders to get “permission” from a civil judge to ask ISPs to disclose the personal details of a user behind a certain IP. Now, however, this also seems to be the case for file-hosting services such as Rapidshare, which is based in Germany. &lt;/p&gt;  &lt;p&gt;This of course opens up the possibility for rights holders to go after a wide range of file-hosting services and potentially even BitTorrent sites. Indeed, everyone who now uploads a torrent file to a site hosted in Germany is at risk of having his personal details revealed. Although it will be impossible to prove that the uploader actually seeded the file it might be seen as assisting in copyright infringement. &lt;/p&gt;  &lt;p&gt;Pretty much all torrent sites keep track of the IP-addresses of their (.torrent) uploaders, and if the rights holders can get the IP-address of people who upload to file-hosting services such as Rapidshare, they can easily extend this to BitTorrent sites hosted in Germany. The BitTorrent tracker site has launched a new feature that allows Facebook users to add torrent listings to their profiles.&lt;/p&gt;  &lt;p&gt;The move has already drawn the ire of Europe's International Federation of the Phonographic Industry. Facebook was not available for comment.&lt;/p&gt;  &lt;p&gt;According to &lt;a href="http://torrentfreak.com/spread-pirate-bay-torrents-via-facebook-090328/"&gt;TorrentFreak&lt;/a&gt;, the new torrent-adding program, &amp;quot;Share on Facebook&amp;quot; takes just one click to place a favorite torrent on one's profile page. A viewer can than click on the torrent listing and if a torrent client is already in place, downloading begins automatically without visiting the Pirate Bay site.&lt;/p&gt;  &lt;p&gt;The verdict in the recent Pirate Bay trial, accusing the site of perpetuating illegal file-sharing, is yet to be delivered. Meanwhile, the new add-to-Facebook feature follows recent news that the site is also offering a privacy service called &lt;a href="http://business.avn.com/articles/34801.html"&gt;IPRED&lt;/a&gt;, designed to foil the tracking of ISP addresses, keeping them anonymous.&lt;/p&gt;  &lt;p&gt;Pirate Bay co-owner Peter Sunde said he hasn't seen complaints over the new site feature, but also added such complaints are quickly deleted. &lt;/p&gt;  &lt;p&gt;However IFPI has complained elsewhere, telling Swiss newspaper &lt;em&gt;&lt;a href="http://www.20min.ch/digital/webpage/story/Piraten-entern-Facebook-19291173"&gt;20 Minuten&lt;/a&gt;&lt;/em&gt; if the new feature is used to offer copyrighted torrent links, then it's a violation and illegal in Switzerland, citing a similar case over the site ShareReactor. There's little doubt rights holders will have the same reaction in most other nations.&lt;/p&gt;  &lt;p&gt;&lt;strong&gt;&lt;em&gt;While it could be argued that Facebook users may list perfectly legal torrents to personal content they wish to share, the concern is the floodgates will open wider for rampant sharing of pirated content. &lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p&gt;TorrentFreak reports that two weeks ago the Brazilian recording industry pressure brought the closure of Google social network page Orkut, boasting nearly a million members. This isn't particularly surprising given that they've very successfully &lt;a href="http://www.afterdawn.com/news/archive/9994.cfm"&gt;avoided arguing&lt;/a&gt; most of them in court, preferring instead to use the obstacle of expensive &lt;a href="http://www.afterdawn.com/news/archive/16689.cfm#"&gt;litigation&lt;/a&gt; to frighten defendants into settling. But sometimes a judge gets the chanceto shine a light on their &lt;a href="http://www.afterdawn.com/news/archive/14547.cfm"&gt;creative readings&lt;/a&gt; of thelaw. In one such case a federal judge has denied the RIAA's claim for damages on the grounds that they must first prove their losses.     &lt;br /&gt;It seems like an obvious enough point. He feels that songs are worth one euro a piece and movies are worth &amp;#8364;15. EliteTorrents, which ceased operating in May 2005, used BitTorrent peer-to-peer technology to distribute pirated copies of movies, software, music and video games, the DOJ said.&lt;/p&gt;  &lt;p&gt;A jury in U.S. District Court for the Western District of Virginia was presented with evidence that Dove was an administrator of a small group of EliteTorrents members known as &amp;quot;Uploaders,&amp;quot; who were responsible for supplying pirated content to the group.&lt;/p&gt;  &lt;p&gt;Dove recruited members who had high-speed Internet connections, usually at least 50 times faster than a typical high-speed residential Internet connection, to become Uploaders, the DOJ said. Dove operated a high-speed server, which he used to distribute pirated content to the Uploaders, the agency said in a press release.&lt;/p&gt;  &lt;p&gt;Dove's conviction is the eighth plea or conviction resulting from Operation D-Elite, a nationwide federal crackdown against the illegal distribution of copyrighted movies, software, games and music over P2P networks using BitTorrent, the DOJ said.&lt;/p&gt;  &lt;p&gt;Operation D-Elite targeted leading members of EliteTorrents. At its height, EliteTorrents attracted more than 125,000 members and distributed about 700 movies, which were downloaded a total of 1.1 million times, the DOJ said.
